US pharmacy giant Walgreens, which is trying to block a proposed deal with Merck & Co. over its Celebrex, could face a legal challenge if it is sued over the drug.

The company was to be the first to admit the patent was invalid, which was filed with the US Food and Drug Administration in May, as part of a drug-safety study that tested a version of Celebrex in a laboratory.

The drug's maker, which was based in the US, will now face a legal challenge, after it won a court order on Tuesday.

A US court has granted a $3 billion verdict for Merck, which filed the patent in June, in the first of two US lawsuits that claim the company illegally patented its drug.

A Merck spokeswoman said the firm is working on a "comprehensive" defence and that the company will have a "comprehensive" defence to its case.

The company, which has already faced similar suits over its rival, AstraZeneca, also has asked a US judge to rule on the litigation.
